Here's what his defense is going to say. Durst went to LA to see his friend Susan Berman. He got to her house and found her brutally murdered. Worried that the police would suspect him he fled but he sent the letter to the cops telling them about her murder.

He'll argue that the bathroom "confession" was just him ironically talking about what others would think of the interview.

Unless Alpert's covered in bacon grease, I don't think Hugo can track anything.

I haven't watched the season finale yet, but I think you're right. Season 2 will likely begin with the judge throwing out the prosecution's "evidence".

I don't know about you, but I'm psyched to see where they take this story next. Best show on TV!!!

In the show during his interviews, Durst maintained that he was never in LA, and that he never wrote or sent the letter. Prosecutors would easily destroy his credibility.

It's been some time since I watched this but didn't it turn out that Durst had mailed the cadaver note before Berman had even been murdered?

The letter was postmarked the day before Berman's corpse was found, but she had rigor mortis indicating she had been dead for around 24 hours. So Berman was killed and whoever posted the letter probably did it shortly after the killing, perhaps the next morning.

I agree with the OP - lawyers will easily argue he was just going through dialogue in his head, making fun of the situation, and mimicking what others think or will think of this new reveal. I wonder if the lawyers can argue that once he went to washroom, anything picked up on the mic is inadmissible, based on Durst assuming the official interview is over, and not agreeing to be recorded outside of that time frame.

None of this would come close to DNA evidence, which is what this case is lacking, in tying Durst directly to the victims.

Great mini series, can't believe the Jury regarding the Morris Black murder.

The guy is about as done as OJ

Even if he somehow gets off, he's forever branded guilty to the general public.

And just like OJ, he'll end up behind bars sooner or later for something else.

unfortunately it may be so. The lawyers may be able to get all the new evidence from the documentary thrown away playing "fruit of the poisonous tree" card and other loopholes
